Terms of Service

These Terms of Service ("Terms") govern your access to and use of OrderBot ("the service", "we", "us"). By creating an account or using the service, you agree to be bound by these Terms.

1. The service

OrderBot is a software-as-a-service platform that connects to your WhatsApp Business number, uses artificial intelligence to interpret customer messages, automatically creates orders, tracks inventory and customer credit, and provides a dashboard for managing the business.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract. You must have authority to bind the business on whose behalf you are using the service. The service is intended for legitimate businesses only.

Violations of WhatsApp policy can result in your number being suspended by Meta. We are not responsible for actions Meta takes against your account.

5. Pricing and payment

Pricing is provided directly to each merchant during onboarding. Payments are invoiced monthly. Outbound WhatsApp messaging fees charged by Meta are passed through and billed separately or included in your plan, as specified at signup. Failure to pay may result in service suspension or termination.

6. Third-party services

OrderBot depends on third-party services including Meta WhatsApp Cloud API, Anthropic, Supabase, Upstash, and our hosting providers. We are not responsible for outages or restrictions imposed by these third parties. Service availability is subject to their availability.

7. AI-generated content

Replies sent to your customers are generated by an AI model based on the context you provide and the customer's message. While we work hard to ensure accuracy, AI can occasionally produce incorrect or unexpected responses. You are responsible for reviewing outgoing messages where critical and for configuring your menu, settings, and templates correctly.

8. Data ownership

You retain ownership of all data you put into OrderBot — your menu, customer information, orders, and ledger entries. We are granted only the rights necessary to operate the service. On account termination, you can export your data within 30 days.

We aim for high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance, deploy updates, or have unplanned downtime. We are not liable for losses caused by service unavailability.

10. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, OrderBot, its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the service. Total aggregate liability is limited to the fees you paid to us in the three months preceding the claim.

12. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your account immediately if you breach these Terms, fail to pay, or use the service in a way that puts our infrastructure or other users at risk. On termination, your access ceases and your data is retained for 30 days for recovery, then deleted.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the dashboard or by email. Continued use of the service after the effective date constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the Islamic Republic of Pakistan. Disputes shall be resolved in the courts of Karachi, Pakistan, unless another venue is agreed in writing.
